Terms of Service
These Terms of Service (“Terms”) govern your access to and use of services provided by MCJC23 LLC, doing business as Rest and Recovery Spa, including our websites, member portal, booking tools, shop, and in-studio services. By using our services, you agree to these Terms.
1. Studio and contact
MCJC23 LLC, doing business as Rest and Recovery Spa, is located at 2665 Royal Forest Dr, Suite B100, Kingwood, TX 77339. Reach us at (281) 312-1130.
2. Eligibility and accounts
You must provide accurate registration information and keep your login credentials secure. You are responsible for activity under your account. Staff accounts are for authorized employees and contractors only. We may suspend or terminate accounts that violate these Terms or pose a security risk.
3. Bookings and studio visits
- Appointments are subject to availability, salon hours, and equipment readiness (including tanning beds and wellness devices).
- Please arrive on time. Late arrivals may shorten or forfeit a session at the desk’s discretion.
- Cancellation and no-show policies may apply as posted in-studio, in the member portal, or communicated at booking. Fees or forfeited credits may apply where disclosed.
- You agree to follow posted safety instructions for UV tanning, spray tan, sauna, and other services, and to disclose relevant health conditions when asked.
4. Memberships
Membership tiers, included services, add-on pricing, billing day, and renewal terms are described at signup and in your portal. Recurring charges are processed through CyberSource using your saved payment method unless cancelled according to the studio’s cancellation process. Tier changes, pauses, and cancellations may be subject to notice periods and proration rules disclosed at the time of the change.
5. Payments, refunds, and shop
Prices are shown in U.S. dollars. Payment authorization may occur at booking, checkout, or on your membership billing day. Retail products, packages, passes, and gift cards are subject to inventory and posted redemption rules. Refunds and voids, when available, are processed back to the original payment method where possible and may take several business days depending on your bank.
6. Acceptable use
You agree not to:
- Misuse booking tools, share accounts, or attempt unauthorized access.
- Interfere with studio equipment, staff, or other guests.
- Use the site to transmit malware, scrape without permission, or reverse engineer systems beyond what the law allows.
- Post unlawful, harassing, or infringing content in any communications we host.
7. Intellectual property
Site content, branding, and software are owned by Rest and Recovery Spa or its licensors. You may not copy or redistribute materials except for personal, non-commercial use related to booking or managing your account.
8. Disclaimers
Wellness and beauty services involve individual risk. Results vary. Online tools are provided “as is” to the fullest extent permitted by law. We do not warrant uninterrupted or error-free access to the website, portal, or payment processors.
9. Limitation of liability
To the maximum extent permitted by law, Rest and Recovery Spa and its owners, staff, and vendors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the services. Our aggregate liability for claims relating to the online services is limited to the amounts you paid us for the specific online transaction giving rise to the claim in the twelve months before the claim.
10. Indemnity
You agree to indemnify and hold harmless the studio from claims arising out of your misuse of the services, violation of these Terms, or infringement of third-party rights, except to the extent caused by our willful misconduct.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Venue for disputes lies in the state or federal courts serving Harris County, Texas, unless applicable law requires otherwise.
12. Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Material changes may also be communicated by email or in-portal notice when appropriate. Continued use after changes become effective constitutes acceptance where permitted by law.
